SwaddleTerms of Use
Swaddle is a baby tracker and a supportive guide. It is not a medical device and not medical advice. If your baby seems unwell, always contact your pediatrician.
These Terms of Use ("Terms") govern your use of the Swaddle mobile app (the "App") and the swaddle website (the "Site"), provided by Swaddle ("we," "us"). By downloading or using the App or the Site, you agree to these Terms. If you do not agree, please do not use them.
1. License to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and the Apple App Store Terms of Service.
2. Not medical advice
Swaddle offers supportive guidance, including nap and bedtime forecasts, cry suggestions, sleep content and calculators, based on the information you log and general pediatric guidance. It does not diagnose, treat, or cure any condition and is not a substitute for professional medical care. Forecasts and suggestions are best estimates, not certainties. Always use your own judgment and consult a qualified healthcare provider about any concern for your baby's health. The guides and tools on the Site are general information.
3. Subscriptions and billing
- Swaddle offers auto-renewing subscriptions (for example, annual or weekly plans). Current prices are shown in the App before you purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription anytime in your Apple ID account settings. Deleting the App does not cancel a subscription.
- If you subscribed through a Swaddle web checkout, manage it at swaddle.superwall.app/manage.
4. Family sharing in the App
If you invite other caregivers, everyone in your family group can see and add to your baby's log. Only invite people you trust, and remove anyone who should no longer have access.
5. Acceptable use
You agree not to misuse the App or the Site, including by attempting to reverse engineer them, interfere with their operation, or use them in any unlawful way.
6. Intellectual property
The App, the Site, their content, branding, characters and design are owned by Swaddle and protected by applicable laws. These Terms do not grant you any rights in our trademarks or content beyond the license above.
7. Disclaimers
The App and the Site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that they will be accurate, uninterrupted, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Swaddle will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App or the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Changes to these Terms
We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms. We will revise the "Last updated" date above when we make changes.
10. Governing law
These Terms are governed by the laws of the United States and the state in which Swaddle is established, without regard to conflict-of-law rules.
